AUSTIN (KXAN) — The households of 5 campers and the 2 counselors who died at Camp Mystic within the July 4 floods filed a lawsuit Monday alleging “gross negligence and reckless regard” for camp protection, calling the camp’s reaction to the fatal floods an “completely preventable tragedy.”
The petition seeks duty for the 27 deaths, consistent with a press unencumber.
“These young girls died because a for-profit camp put profit over safety,” the petition alleged. “The Camp chose to house young girls in cabins sitting in flood-prone areas, despite the risk, to avoid the cost of relocating the cabins.”
Camp Mystic is positioned alongside a high-risk flood zone house alongside the Guadalupe River, sometimes called “Flash Flood Alley.”
The petition alleged the camp “failed to adopt legally required evacuations plans, ignored repeated weather warnings, and implemented unsafe policies,” according to the discharge. Additionally, it alleged that Camp Mystic “ordered campers to remain in their cabins” as floodwaters rose and that advancement “delayed evacuation to protect equipment rather than lives.”
“We carry the memory of our daughter in everything we do,” stated Ryan DeWitt, father of Molly DeWitt. “This legal step is one of honoring her, and we believe that trust and justice are essential to finding peace — not only for our family, but for every family affected.”
Attorneys for the households are Paul Yetter, Justin Tschoepe, Reid Simpson and Shannon Smith of Yetter Coleman, LLP.
Yetter stated their purchasers filed a lawsuit to hunt duty and fact. “Camp Mystic failed at its primary job to keep its campers and counselors safe, and young girls died as a result,” stated Yetter. “This action is about transparency, responsibility and ensuring no other family experiences what these parents will now sugar the rest of their lives.”
